GetProofed helps you keep photos, visits, payments, and papers organized. It is not legal advice, not a lawyer, and not a court or mediator. For legal strategy, talk to a professional where you live. The full terms are in Section 5.

Uploads & hold-harmless

By uploading, you confirm you own those materials or have permission to use them. You agree Citinet Solutions, LLC is not liable for disputes arising from what you upload. You upload at your own risk. See Section 13.

Where data lives

Projects and photos are stored on this browser / device. Clearing site data removes them. Pro checkout may store account details with our payment partner (Citinet Solutions / NMI) — separate from your photo library.

Deleting data

• Delete a project in the app (trash) to remove it and its photos from this device and, if you own it, from your account.
• Settings → delete all data on this device to wipe local GetProofed storage (projects backed up to your account stay there; email support@getproofed.ai to delete your account data).
• You can also clear this site’s data in your browser settings.

1. Agreement

These Terms & Conditions (“Terms”) govern access to and use of GetProofed at https://getproofed.ai, the web app, checkout, and related pages (the “Services”), offered by Citinet Solutions, LLC (“GetProofed,” “we,” “us”). GetProofed is a product of Citinet Solutions, LLC. By using the Services, creating an account profile, or completing checkout, you agree to these Terms, our Privacy Notice, Refund Policy, and Secure Checkout page. If you do not agree, do not use the Services.

2. Who we are

3. Eligibility

You must be at least 18 years old. If you use GetProofed for a business, you represent you have authority to bind that business. Provide accurate name, contact, and billing information and keep it current.

4. The product

• Homeowners: free use of core on-device job documentation features.
• Contractors / Pros: optional Pro subscription at a flat $49 per month (1 seat) for Pro features described on the site and in-app (for example professional share links and related Pro tools). Cancel anytime under the Refund Policy.
• Invite/share features let you share what you choose with the other party. You decide who receives a link or invite.

6. Accounts and acceptable use

You are responsible for activity on your device profile and for safeguarding access. You will not:

• Use the Services for unlawful purposes, fraud, or abuse
• Upload malware, attempt to disrupt security, or scrape the site abusively
• Misrepresent your identity or business
• Collect or transmit full payment card data outside approved checkout fields
• Upload content you do not have rights to use, or that infringes others’ rights

We may suspend or terminate access if we reasonably believe these Terms, processor rules, or law have been violated.

7. Fees and billing

Pro pricing is shown at checkout (flat $49/month unless a promo applies). You authorize Citinet Solutions, the merchant of record for GetProofed Pro, and its payment processor (NMI) to charge the payment method you provide for amounts due. Charges appear on your card statement as “Citinet Solutions.” Failed payments may result in loss of Pro features. Subscriptions renew until cancelled per the Refund Policy. Refunds are always at the sole discretion of Citinet Solutions, LLC, except that verified billing errors (such as duplicate or incorrect charges) are always refunded, as described in the Refund Policy. Please email support@getproofed.ai before disputing a charge with your bank.

Card payments are processed by our third-party processor. We do not store full primary account numbers or CVV on GetProofed servers. See Secure Checkout.

8. Intellectual property

Citinet Solutions, LLC retains rights in the software, branding, and documentation. You receive a limited, non-exclusive license to use the Services while in good standing. You retain ownership of your photos and content; you grant us a limited license to process billing/account data as needed to provide Pro and support.

9. Confidentiality and customer data

Each party will protect the other’s confidential information with reasonable care. Personal data handling is described in the Privacy Notice. You represent you have rights to submit any data you provide.

10. Service level

Unless a separate written agreement says otherwise, Services are provided on a commercially reasonable efforts basis. We do not guarantee uninterrupted or error-free operation. Projects that were never saved to your account are stored only on that device, and you are responsible for backing them up.

11. Disclaimers; “as is,” no warranty

EXCEPT FOR ANY WARRANTY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, THE SERVICES AND ALL RECORDS, CONTENT, AND OUTPUT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITINET SOLUTIONS, LLC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the above, we do not warrant that: the Services will be uninterrupted, timely, secure, or error-free; photos, timestamps, or other data will be accurate, complete, or preserved without loss (keep your own copies); any record will be accepted as evidence or proof by anyone (see Section 5); the Services will meet your requirements or achieve any particular result in a dispute, claim, or transaction; or third-party networks and services (including payment networks, app stores, and your device or browser) will be available or work as expected. No advice or information you obtain from us, whether oral or written, creates any warranty not expressly stated in these Terms.

12. Limitation of liability

To the maximum extent permitted by law, Citinet Solutions, LLC and its members, managers, officers, employees, contractors, agents, and payment processors (together, the “GetProofed Parties”) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, or savings, lost or corrupted data or photos, business interruption, or the cost of substitute services, however caused and under any theory of liability, even if advised of the possibility of such damages.

Without limiting the above, the GetProofed Parties are not liable for: any dispute between you and a homeowner, contractor, or other user or third party; any decision by a court, insurer, lender, agency, or other person to reject or discount a record; your reliance on any record, status, or content in the Services; or content that you or other users upload or share.

The GetProofed Parties’ total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the fees you paid for Pro in the three (3) months before the event giving rise to the claim. These limits apply even if a remedy fails of its essential purpose, and do not apply to liability that cannot be limited or excluded under applicable law (including New York law).

13. Indemnification and hold harmless

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Citinet Solutions, LLC and its members, managers, officers, employees, contractors, agents, and payment processors (including the merchant of record for GetProofed Pro and its processor) from and against all claims, demands, suits, proceedings, losses, liabilities, damages, judgments, settlements, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your access to or use of the Services; (b) any content you upload, record, or share, including any claim that it is inaccurate or infringes or violates anyone’s rights, including privacy or intellectual-property rights; (c) any dispute between you and a homeowner, contractor, or other user or third party; (d) your reliance on, or submission of, any record to any court, insurer, lender, agency, or other person; (e) your violation of these Terms or any law; or (f) billing disputes or chargebacks related to your Pro subscription, except where we billed in error.

We may assume the exclusive defense and control of any matter subject to indemnification by you, and you will cooperate with our defense. You will not settle any such matter without our prior written consent.

14. Term and termination

These Terms apply while you use the Services. You may stop using the free app anytime and delete local data. Pro cancellations follow the Refund Policy. We may terminate for non-payment, fraud, legal/processor mandate, or material breach.

15. Electronic communications

You consent to receive notices electronically at the email on file. Click-wrap acceptance at checkout and payment authorizations are valid.

Text messages (SMS)

GetProofed project updates are optional text messages from GetProofed, a product of Citinet Solutions, LLC. You opt in inside the app under Profile > Notifications by choosing Text, entering your mobile number, checking the consent box, and confirming the one-time code we text you. Consent to texts is not a condition of using GetProofed or of any purchase.

• What we send: short updates when someone adds photos to or changes a project you share in GetProofed, insurance (COI) expiry reminders (for contractors, before and when their certificate on file expires; for people on their projects, one heads-up if it lapses), and one-time codes to confirm your number. We do not send marketing texts.
• Frequency: message frequency varies with project activity: at most one update every 30 minutes per project, up to 6 update texts a day, and none between 9 PM and 8 AM in your time zone.
• Message and data rates may apply.
• Opt out and help: reply STOP to cancel at any time; that number then gets no further GetProofed texts (reply START to resubscribe). Reply HELP for help, or email support@getproofed.ai. You can also switch Text off under Notifications.
• Wireless carriers are not liable for delayed or undelivered messages.

Project invites by text. When you are signed in, you can enter the cell number of the homeowner or contractor you are working with on a project to send them one text with a link to that shared project. Only enter the number of someone you are working with on that project who expects to hear from you. Each invite is a single message and does not sign the recipient up for recurring texts; the recipient can reply STOP to block further GetProofed texts. Invite texts are rate-limited (including 3 per phone number per day) and are never sent to numbers that replied STOP.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Exclusive venue is state or federal courts in Westchester County, New York. Before filing a claim, the parties will attempt in good faith to resolve the dispute within thirty (30) days after written notice.

17. Changes

We may update these Terms by posting a revised version and updating the effective date. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services and cancel Pro as provided in the Refund Policy.

18. Entire agreement

These Terms, the Privacy Notice, Refund Policy, Secure Checkout page, and any order confirmation constitute the entire agreement regarding the Services. If a provision is unenforceable, the remainder stays in effect.
